Hive-X Terms of Service

Welcome to Hive-X. These Terms of Service ("Terms") govern your use of the Hive-X mobile application ("App") operated by Hive-X ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Hive-X, you confirm that you are at least 18 years of age and agree to comply with these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Hive-X is a construction project management application designed for small teams. The App provides tools for project tracking, team coordination, file management, calendar scheduling, issue tracking, and client communication. The App supports three user roles:

• Team Leader: Full access to all features, team management, and subscription management.
• Team Member: Collaborative access to team projects and features.
• Client: Read-only and limited access to projects they have been invited to view.

3. Account Registration

To use Hive-X, you must create an account by providing accurate and complete information including your name, email address, and password. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account.

4. Subscription Plans and Pricing

Hive-X offers the following subscription tiers (prices in Australian Dollars):

4.1 Free Plan (AUD $0.00/month)

• Up to 4 team members
• Up to 3 active projects
• Core project management features

4.2 Standard Plan (AUD $11.99/month)

• Up to 8 team members
• Up to 6 active projects
• Folder organisation for files
• Calendar export

4.3 Business Plan (AUD $19.99/month)

• Unlimited team members
• Unlimited active projects
• Client portal invitations
• Project summary downloads
• All Standard features included

4.4 Subscription Management

Subscriptions are managed on a per-team basis. Only the team creator can purchase, upgrade, downgrade, or cancel the team's subscription. All team members benefit from the active subscription tier.

4.5 Client Access

Clients invited to view projects do not require any subscription. Client access is provided free of charge and is not subject to subscription tier restrictions.

5. Billing and Payment

• All subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions.
• Subscriptions automatically renew on a monthly basis unless cancelled at least 24 hours before the end of the current billing period.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• You can manage and cancel your subscription through your Apple ID account settings or the App Store.

6. Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's standard refund process. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

7. User Content

You retain ownership of all content you upload to Hive-X, including but not limited to photos, documents, plans, notes, and project data ("User Content"). By uploading User Content, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the App's services to you and your team.

You are responsible for ensuring that your User Content does not violate any laws or infringe upon the rights of any third party.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload content that is harmful, offensive, or infringes on intellectual property rights.
• Attempt to gain unauthorised access to other users' accounts or data.
• Interfere with or disrupt the App's infrastructure or services.
• Use automated tools to access the App without our consent.
• Share your account credentials with others.

9. Account Deletion

You may delete your account at any time through the App's Profile settings. Upon deletion:

• Your personal data, team memberships, and client associations will be permanently removed.
• Any active subscription must be cancelled separately through your Apple ID settings to prevent further charges.
• Content you contributed to team projects may be retained for the team's benefit unless the entire project is deleted.

10. Intellectual Property

The Hive-X App, including its design, features, code, and branding, is the property of Hive-X and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

• Hive-X is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation of the App.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
• Our total liability to you shall not exceed the amount you have paid for the App in the preceding 12 months.

12. Privacy

Your use of Hive-X is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately, though applicable provisions of these Terms will survive.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of Australian courts.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
